Terms of service

1. Who you are dealing with

Lusove is a series of NextCTR LLC, and "we", "us" and "our" on this page mean Lusove. The store runs on the Shopify Inc. platform, which supplies the tools we use to sell to you online. These Terms of Service and our Privacy Policy form the agreement between you and Lusove. Visiting the site, browsing it or buying from it means you agree to them. If you would rather not agree, please do not use the site.

2. Your side of it

To use the site you must have reached the age of majority where you live. Details you give us, such as an email address, billing, payment and shipping information, must be accurate, current and complete, and any login credentials are yours to keep secure. The site is for lawful use. Do not use it, or anything on it, to (a) infringe our intellectual property or anyone else's, (b) supply information that is false or misleading, (c) upload viruses or any other harmful code, (d) collect or track other people's personal information, or (e) restrict or interfere with anyone else's use of the services.

3. Products and prices

Every screen renders colour a little differently, so the shade you see may not be exactly the shade that arrives, even though we photograph every item as accurately as we can. Prices may change at any time without notice, and unless we say otherwise they exclude state and local taxes. We can restrict the sale of any item to particular people or regions, and we can withdraw a product at any time without notice. Now and then a listing contains a typographical mistake, an inaccuracy or an omission, in a price, a description, a promotion or an availability note; when that happens we may correct the information, update it, or cancel an order placed on it, at any time and without prior notice.

4. Orders and payment

When you place an order you are making an offer to buy; Lusove can accept it, limit it or decline it for any reason. Because orders move into processing quickly, the window for changes and cancellations is short, normally 2 hours from the time the order was placed; after that the Refund and Return Policy governs. You confirm that you are authorized to use the payment method you give us and that your bank or card provider will approve the charge, and you agree to keep your purchase and account details accurate, current and complete.

5. Delivery

We work with reliable carriers, but delays caused by a carrier, by severe weather or by handling beyond our control are not something we can be held liable for, and every delivery time we quote is an estimate. While a parcel is in transit it is our responsibility: if it is lost on the way, or damaged when it arrives, email support@lusove.com so we can open an inquiry with the carrier; once the carrier confirms the loss or the damage, a replacement or a refund follows, as set out in the Shipping Policy. Damage and defect claims must arrive within 7 days of delivery, under the Refund and Return Policy. Once the carrier has scanned the parcel as Delivered at your checkout address, the risk of loss passes to you, and Lusove cannot be held liable for a parcel lost or stolen after that point. Where the address you provided was wrong or incomplete and the delivery fails, the undelivered parcels section of the Shipping Policy applies and a second shipment may carry an additional fee.

6. Content and links

The Lusove name, and the text, photographs, graphics, logos and design on this site, are ours or our licensors' and are protected under copyright and other intellectual property law; do not reproduce, copy, sell or exploit any of it without our written permission. Some links lead to third party sites that we do not operate; we do not review them, and we are not liable for harm or loss tied to a purchase or service made through one of them.

7. Shopify

Shopify Inc. hosts the store and provides the infrastructure it runs on. Your purchase is a contract with Lusove alone; Shopify is not a party to it and has no responsibility for claims about a product you buy from us. Our Privacy Policy explains how anything you submit through the store is handled and, since the store runs on Shopify, some of that information is processed by Shopify in order to provide the services.

8. Your submissions

Ideas, suggestions, reviews and proposals you send us, by email, online or any other route, become ours to edit, copy, publish and use in any medium and at any time, without limit. We are under no obligation to treat them as confidential and no payment is due for them.

9. Warranties and liability

We provide the website and its services "as is" and "as available"; we do not promise the site will be uninterrupted, timely, secure or error free. That disclaimer is about the website and services only, and not about the products: nothing here removes, limits or changes a warranty, guarantee or other right you have under consumer protection law, including any implied warranty that the law forbids us to disclaim, and the Refund and Return Policy explains what we do about a faulty, damaged or incorrect item. To the fullest extent permitted by law, and except where the law forbids the exclusion, Lusove, together with our directors, officers, employees and suppliers, is not liable to you for indirect, incidental, special or consequential loss connected with your use of the site or its services.

10. Indemnity

If your breach of these Terms, of the law or of someone's rights leads to a claim or demand from a third party, you agree to indemnify and hold harmless Lusove and NextCTR LLC, along with our officers, directors, employees, agents, contractors, subsidiaries and partners, including reasonable attorneys' fees.

11. Disputes and governing law

This section affects your legal rights. Any dispute, claim or controversy connected with these Terms or with something you bought from Lusove is settled by binding, individual arbitration, not in court, administered by the American Arbitration Association (AAA) under its rules. You and Lusove both waive a jury trial and waive any right to join a class action, a class arbitration or another representative proceeding. These Terms are governed by the laws of the State of Texas, United States, and so is any separate service agreement between you and us. Should any provision be found unlawful, void or unenforceable, that provision is severed, the rest of the Terms stay in force, and the severed provision still applies as far as the law allows.

12. Changes and contact

We can revise or replace any part of these Terms by posting the new version here. It is your responsibility to look in from time to time, and if you continue to use the site once a change is up, you have accepted it. Questions about these Terms: support@lusove.com.
